These Terms of Use ("Terms") govern your access to and use of the website and services operated by TelecareHealth US LLC ("we," "us," or "our"). By using the site, you agree to these Terms. If you do not agree, do not use the site.

Nature of our services

We provide a technology platform and administrative services that connect you with independent, state-licensed healthcare providers and independent licensed pharmacies. We do not practice medicine or pharmacy. All clinical decisions — including whether to prescribe — are made solely by independent providers exercising their own professional judgment, and all dispensing is performed solely by independent licensed pharmacies.

Not for emergencies

The services are not intended for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room.

Eligibility

• You must be at least 18 years old and located in a state where the services are available.
• You must provide accurate, complete, and current information, including during medical intake and identity verification.
• You may use the services only for yourself, not on behalf of another person.

Accounts

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

Payments, subscriptions, and cancellations

• Program prices are displayed before checkout and include the provider evaluation, prescribed medication (if approved), supplies, support, and shipping unless stated otherwise.
• Subscriptions renew automatically each billing period until you cancel. You may cancel any time via the patient portal or by contacting support before your next billing date.
• You will not be charged for medication if a provider determines treatment is not appropriate.
• Our services are cash-pay. You agree not to submit claims for these services or medications to any commercial or government insurance program.

Prescription products

Prescription products, including compounded medications, are available only pursuant to a valid prescription issued by a licensed provider. Compounded medications are prepared by state-licensed pharmacies and are not FDA-approved. Read all safety information provided with your medication and direct clinical questions to your provider.

Prohibited conduct

• Providing false or misleading information, including during medical intake.
• Using the services on behalf of another person or reselling any product or service.
• Interfering with the operation or security of the site.
• Infringing the intellectual-property or other rights of any party.

Intellectual property

The site and its content, features, and functionality are owned by us or our licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES. CLINICAL CARE IS PROVIDED SOLELY BY INDEPENDENT LICENSED PROVIDERS AND PHARMACIES, WHO ARE RESPONSIBLE FOR THEIR OWN PROFESSIONAL ACTS.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms or misuse of the services.

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. [Dispute-resolution / arbitration provisions to be finalized with counsel before launch.]

Changes
